DORAN, J.

Defendant was charged by information with the violation of section 288 of the Penal Code. A jury was waived. Defendant was adjudged guilty as charged. A motion for a new trial was denied and the appeal is from the order denying said motion.

The alleged victim is defendant's niece, 7 years old at the time the offense was committed, was 8 years of age on the day of trial.
