The plaintiff in error, hereinafter referred to as defendant, in the within case has appealed to this court for the second time. In an opinion of December 1, 1948, reported as Story v. State, 88 Okla.Cr. 141, 200 P.2d 774, the case was reversed and remanded for a new trial.
