Plaintiff brought this suit seeking to recover the sum of $31,651 in the nature of personal injuries sustained in an accident which occurred on December 1, 1947, allegedly as the result of the negligent operation of a winch truck and its equipment by the defendant, Kennedy, whose liability insurer is joined as a party defendant.
