Leon M. Male, defendant, operated an outdoor motion picture theatre in Whitehall Township, known as the Seventh Street Drive-In Theatre. Plaintiff, Whitehall Township, on March 8, 1948, enacted ordinance no. 460 which imposed a tax for general township purposes upon admissions to amusements in the township.
