BRETT, J.

The defendants, Ben Lane and D.A. Thomason, were charged by information in the district court of Stephens county, Okla., with the crime of grand larceny, wherein it was alleged that they stole from W.F. Turner 18 9" rock bits of the value of $75 each, on August 7, 1947. They were tried by a jury, convicted and their punishment fixed at one year in the State Penitentiary, and judgment and sentence was pronounced accordingly.
