DOOLING, J.

Defendant appeals from the judgment of the Superior Court sentencing him to the state penitentiary after an order revoking his probation. Appellant pleaded guilty to a charge of conspiracy to commit abortion and was placed on probation for five years on condition that he serve one year in the county jail. Before the year had expired on the court's own motion proceedings were instituted to revoke his probation.
