ADAMS, J., October 13, 1950.

Defendant, Louis Schindler, was indicted for perjury and found guilty by a jury. Motions for a new trial and in arrest of judgment have been filed. Only one of the several contentions advanced by defendant need be considered. It is urged that a new trial must be granted because the court failed to instruct the jury concerning the two-witness rule. Although defendant did not request such instruction, we believe that it was fundamental error...
