At the September, 1949, term of the Intermediate Court of Kanawha County, an indictment for murder was returned by the grand jury against Harry Atlee Burdette and Fred Clifford Painter. The indictment charged that the defendants "on the ___ day of July, 1949, in the said County of Kanawha, feloniously, wilfully, maliciously, deliberately, premeditatedly and unlawfully did slay, kill and murder one Edward C....
