GREGORY, Justice.

The accused, R. C. Anderson, was indicted for having produced an abortion upon the body of one Virginia Lee Hunter, in violation of Code 1942 (Michie), § 4401, and was found guilty by the jury of an attempt and his punishment fixed at three years in the penitentiary. He was accordingly sentenced by the court.
