MATTER OF DISBROW v. BD. OF EDUC. OF CITY OF NEW ROCHELLE

276 A.D. 1015 (1950)

In the Matter of Elizabeth B. Disbrow et al., Respondents, v. Board of Education of the City of New Rochelle, et al., Appellants

Appellate Division of the Supreme Court of the State of New York, Second Department.

March 6, 1950.

Order reversed on the law and the facts, without costs, and petition dismissed, without costs.

The appellant board had the power to abolish the positions which had been held by the petitioners. The prescribed duties of the newly created positions do not, in our opinion, include any work which may be said to be pedagogic in nature. The findings of fact and conclusions of law are reversed and new findings and conclusions will be made.
