This suit arises out of personal injuries sustained by the plaintiff and the amount of damage to his automobile as a result of the alleged drunken and negligent driving by Edgar Melvin of his Buick sedan, which was insured against public liability by the American Fire and Casualty Company to the extent of $10,000.
