The appellant, Herschel Hendrickson, has been convicted of the murder of his brother-in-law, Elmer Sevier, and condemned to pay the extreme penalty of death. It is rare indeed that this court finds not sufficient in law to have even authorized the submission of the case, the evidence which a jury believed beyond a reasonable doubt to justify a verdict of such fatal consequences.
