On April 28, 1949, the defendant, George S. Vineyard, entered into an agreement with the Panhandle Roofing Company to repair 1000 square feet of roofing covering the western portion of a building occupied by the Sunshine Dairy. The work required the removal of part of the roofing and the pouring of 2½ inches of gypsum decking. The work began on April 29, 1949, and before the work was completed a heavy rain fell, and water entered the building...
