Plaintiff sues for his salary from January 20, 1942 to May 12, 1945, as Examiner in the United States Immigration and Naturalization Service, Department of Justice.

It is conceded by stipulation that his dismissal from the Service on January 20, 1942, was not in accord with the requirements of Sec. 6 of the Act of August 24, 1912, 5 U.S.C.A. § 652. It is further conceded that the essential facts in this case are the same as the facts...
