As verdicts of guilty were returned only under Count Two and against only Sheriff John William Lynch and Deputy Sheriff William M. Hartline, the questions of law are considerably narrowed. This opinion covers defendants' plea of former jeopardy, motion to dismiss the indictment, and motion for a new trial under Count Two.
