WILSON, J.

This is an action for personal injuries brought under the Federal Employers' Liability Act. (35 Stats. 65; 45 U.S.C.A. § 51.) Defendant's motion for nonsuit was denied as was its motion for a directed verdict. The jury failed to arrive at a verdict and was dismissed whereupon defendant moved for judgment under section 630 of the Code of Civil Procedure1 and its motion was granted. Plaintiff appeals from the judgment.
