CAVE, Judge.

This is a malicious prosecution suit. Trial before a jury resulted in a verdict and judgment in favor of the plaintiff for actual and punitive damages. The defendant has appealed.

The amended petition is cast in two counts. The first alleges a cause of action for false arrest and imprisonment, and the second for malicious prosecution. At the close of all the evidence the court sustained defendant's motion for a directed verdict on the first count...
