Plaintiff sued the heirs and beneficiaries in the will of Samuel Rosenberg, deceased, praying for specific performance of an alleged oral agreement whereby, plaintiff alleged, in consideration of personal services rendered and to be rendered, deceased promised to devise and bequeath one-fourth of his estate to plaintiff.

No witness testified that he actually saw plaintiff render any service...
