Defendant was convicted by a jury in 1928 of murder in the first degree. This is an appeal, upon leave granted, from the trial court's order of August 28, 1947, denying a new trial.

Defendant contends that when it directed the drawing of talesmen in addition to the jurors on the regular panel the trial court erred in limiting such drawing to the townships and cities...
