The plaintiff appeals from a judgment, setting aside the verdict of a jury in his favor, and dismissing his complaint in an action to recover for personal injuries incurred while boarding a ship of which the defendant was the owner. The plaintiff testified that the injury happened because of the breaking of the wooden rung of a Jacob's ladder which led to the ship's deck from a barge, moored alongside the ship.
