Plaintiff wholesales and retails fresh fruits, vegetables, and groceries in Minneapolis, Minnesota, and other parts of the country. Defendant is a common carrier by rail subject to Part I of the Interstate Commerce Act, 49 U.S.C.A. § 1 et seq., and operates the only railroad switching facilities which serve plaintiff's Minneapolis plant and warehouse.
