Mr. JUSTICE THOMPSON delivered the opinion of the court:

Plaintiff in error, Albert Gooden, hereinafter called the defendant, was indicted in the criminal court of Cook County for the crime of armed robbery. He entered a plea of not guilty, was tried before a jury and at the close of all the evidence was found guilty as charged in the indictment. He was sentenced to the penitentiary for a term of not less than four nor more than eight years...
