Plaintiff rented the upper duplex at 2816 Fifth Avenue South, Minneapolis, from the defendants, and since December, 1947, and up to April, 1949, he has paid a monthly rental for said premises in the sum of $50. Since January 20, 1943, the maximum rental for the upper duplex established by the Office of the Housing Expediter, Minneapolis Area Rent Office, has been $29 per month.
