Four of the twenty claims in appellant's application for a patent for improvements in a Photo-Electric Marksmanship Device were rejected by the Primary Examiner in the Patent Office, the remaining sixteen claims being allowed. That rejection was affirmed by the Board of Appeals of the Patent Office. The basis of rejection was that of lack of patentability over the prior art.
