Defendant was convicted of first-degree murder by a jury in the circuit court of Oakland county. The information against him charged that on, to-wit, the 10th of May, 1947, at the township of Orion in said county, the defendant "feloniously, wilfully and of his malice aforethought, did kill and murder one Richard Edward Schweitzer."
