LUTTRELL, J.

Plaintiff, Hugill, brought this action against defendant, Doty, for personal injuries sustained by plaintiff when struck by an automobile belonging to and driven by defendant. Defendant in his answer denied negligence, alleged contributory negligence, and further pleaded that the accident was unavoidable. The trial court submitted the case to the jury, which returned a verdict in favor of defendant, and plaintiff appeals.
