Plaintiff in error, John Yurkiates, was convicted of robbery in the criminal court of Cook County on April 4, 1933, and sentenced to imprisonment in the Illinois State Reformatory at Pontiac. On April 25, 1933, the court vacated such sentence and resentenced plaintiff in error to imprisonment in the penitentiary at Joliet.
