Plaintiff brought this action to recover the face value ($2,000) of a policy of life insurance issued by defendant on October 15, 1942, to her husband, Mitchell V. Tennison, who died September 12, 1946. Defendant denied liability on the grounds the policy was not in effect at the date of insured's death because of default in payment of the annual premium of $41.80 due October 15, 1945.
