Plaintiffs sued the defendant in the circuit court for Kent county in an action of trespass on the case for damages, claiming that the defendant had defrauded plaintiffs in a transaction for the sale and purchase of a house. The gist of plaintiffs' claim is that the defendant fraudulently concealed the fact that the house was infested with termites, and misrepresented the facts in that regard.
