Plaintiff in error, Robert Smith, hereinafter referred to as defendant, was tried in the circuit court of St. Clair County on an indictment charging him with the murder of William North. A jury found him guilty of manslaughter and the court entered judgment sentencing him to the penitentiary for a term of not less than one nor more than fourteen years.
