Plaintiff in error, Max Mosher, hereinafter called defendant, was jointly indicted with one Roland Anderson, in the criminal court of Cook County, for the crime of rape on a female of the age of fifteen years. He made a motion for a severance and a separate trial which was denied. In the joint trial that followed both defendant and Anderson were found guilty by a jury and their punishment...
