The appellants sought to enjoin the City of Winter Garden from allowing the surface waters within its limits to be cast upon their lands and to collect for the damage they had suffered.

As a basis for this relief they alleged that the municipality maintained a system of sewers, culverts, ditches, and canals for the collection and disposal of surface waters, and they charged that the city not only permitted water to accumulate in such quantity...
