On the morning of October 12, 1944, about two o'clock, the plaintiff-appellant ran his one-ton International truck into the defendant-appellee's train which was standing still across the county road which plaintiff was traversing. He brought this action to recover for personal injuries and damages to his truck. At the close of all the evidence in the case, the trial court directed a verdict for defendant upon the ground that plaintiff's evidence...
