The first ground of the amended motion for a new trial is numbered "4" and excepts to the following excerpts from the charge of the court: "Now, I charge you, if you should believe beyond a reasonable doubt that the defendant is guilty of the offense of murder, of course you would be authorized to write a verdict to that effect...
