Plaintiff in error, James Gates, was indicted in the circuit court of Hancock County for the crime of attempted burglary. He pleaded not guilty and was tried by a jury which returned a verdict on March 28, 1947, finding him guilty. After a motion for a new trial was denied, the court sentenced him to a term of from one to five years in the penitentiary...
