The defendant appealed from the denial by the court below of his motion to strike certain portions from the plaintiff's complaint.

In her complaint plaintiff alleged that she was induced by the defendant to pay $2500 as part payment on the purchase price of certain real property in Charlotte, the defendant paying $5000 and taking title thereto in his own name, and that defendant had agreed at the time that title would be made to her upon repayment...
