On a prior appeal this court reversed a judgment entered on the verdict of a jury in favor of the plaintiff in this action and dismissed the complaint upon questions of law (273 App. Div. 252). This determination was reversed by the Court of Appeals on the ground that a factual issue existed as to whether the decedent's death was due to accident within the meaning of the policy, and the matter was remitted...
