This suit is brought on behalf of a minor, by his tutor, to recover workmen's compensation or, in the alternative, damages in tort for personal injuries arising out of an accident, which happened while the minor was engaged on a painting job at the Southdown sugar factory of the defendant, Southdown Sugars, Inc., on May 29, 1947. The minor, Merlin A. Cutrer, was born on March 7, 1930 and consequently on the day of the accident, was 17 years, 2 months...
