In the court below the petitioner's writ of habeas corpus was denied. This is the second appeal in this cause. 37 So.2d 678.

On the former appeal we reversed the judgment of the court below and remanded the cause. We held that the trial judge fell into error by disallowing the petitioner the right to make proof, if he could, that the extradition proceedings were instituted for the purpose of collecting a civil demand.
