HUDGINS, Chief Justice.

The grand jury returned two indictments against Creed Epps. One charged him with maliciously shooting and wounding Ollie Hazlewood, with intent to maim, disfigure, disable and kill, and the other with maliciously shooting and wounding George Hazlewood, with the same intent. The cases were tried together and the accused was convicted on both indictments and sentenced on each to five years confinement...
