This is an appeal from a judgment based on the verdict of a jury in favor of the plaintiff suing to recover a commission for services rendered in connection with the sale of timber owned by the defendant.

Plaintiff had no written contract of employment. He alleged in his complaint that he was employed by by the defendant "only to find and introduce a purchaser", that he "was not to negotiate any sale of said timber and that defendant...
