The defendants demurred to the petition on two grounds, first that no cause of action was set forth, and second that there was a misjoinder of parties and causes of action in that the plaintiff sought to proceed in the same action with a suit sounding in contract against the defendant insurance carrier, and with a suit sounding in tort against the defendant driver, Green.
