Appellant, at the commencement of the trial in this divorce action, made a motion for leave to file an amended answer setting up, for the first time, a cross-complaint for a divorce. He renewed the motion at the close of the trial and, at that time, also moved that the pleadings be deemed amended to conform to the proof as a basis for determining whether appellant should be granted a divorce.
