On October 28, 1931, appellee Ruby Mina Maxwell recovered judgment for divorce against John H. Maxwell in a district court of Tarrant County, Texas.

In the year 1942, John H. Maxwell instituted a suit in the district court of Dallas County, Texas by filing an application for writ of habeas corpus, wherein he sought possession of their child, Zella Rosemary Maxwell.
