This matter is before the Court on a motion for summary judgment by the defendant.

The facts briefly are that defendant, New York Life Insurance Company, a corporation of the State of New York, issued, on July 9, 1943, a policy of life insurance in the face amount of $50,000 to the insured, David Grimes, a resident of this district. Prior to the date of the insured's death, there had been paid one premium in the amount of $5,627...
