Clayton sued Smith in the City Court of Floyd County to recover money lost in gambling transactions. The jury returned a verdict for the plaintiff for $3000 on March 22, 1949, judgment was rendered accordingly, the defendant excepted to the overruling of a motion for a new trial and brought the case to this court, and the plaintiff, the defendant in error here, moved to dismiss the writ of error.
