The above entitled action came on for hearing in open court at Des Moines, Iowa, on its merits, on the 31st day of December, 1947, and was submitted to the court for decision without arguments.

On June 15, 1946, the defendant purchased from the plaintiff 2250 cases of clingstone peaches. The transaction was in writing and therein it is recited that the buyer (defendant herein) — "has this day bought, and Honor Brand Frosted Foods...
