After trial the jury disagreed and was discharged. The defendant had offered no testimony, but moved for judgment in its favor at the end of plaintiff's testimony, and has now renewed its motion.

The defendant has a main-line railroad between the boroughs of North Braddock and Braddock which has two west tracks on the North Braddock side and two east tracks on the Braddock side.
