Plaintiff-appellee is engaged in the manufacture of baker's yeast in the City of Crystal Lake, Illinois. By virtue of a contract entered into on November 10, 1939, between the Yeast Company and the City, expiring five years from the date thereof, plaintiff discharged its waste into the storm sewers of the city and continues to do so regardless of the expiration date of the contract.
