The petition of William A. Heath to the district court, brought against R. O. Jones as propounder and executor of the will of Miss Lilla May Leigh, was dismissed on a motion presenting the grounds that the court had no jurisdiction of the subject matter, being the probate of a will and the administration of an estate thereunder, and that no claim was stated on which relief could be granted.
